1. Prize Draw

(a) These terms and conditions apply to the ChargeNet “win a year of free charging” competition (Competition).
(b) By entering the Competition, you confirm that you have read and agree to these terms and conditions.

2. The Promoter 

(a) The promoter of the Competition is ChargeNet NZ Limited, at 6b Piermark Drive, Rosedale, Auckland, 0632, New Zealand (Promoter).
(b) The address for any correspondence (including any inquiries) relating to the Competition is the business address of the Promoter in clause (a) above.

3. Competition Period 

(a) Competition entries can be made from 12.00am (NZST) on 16 July 2024 until 11.59pm (NZST) on 15 August 2024 (Competition Period). 

4. Prize 

(a) The prize is one year’s worth of free charging capped at $2,000 (via a personal ChargeNet account) at any public ChargeNet charging station (Prize). The Prize will be awarded in the form of a $2,000 credit on the Winner’s personal ChargeNet account, however, if the full $2,000 credit has not been used by the end of the relevant year, the credit will expire and will not be roll over into the following year.
(b) The $2,000 cap on the value of the Prize is based on an assessment undertaken by the Promoter of the average amount ChargeNet’s personal customers spent on charging their vehicles over the last 12 month period, which is well below $2,000.
(c) The Prize cannot be used in connection with any commercial ChargeNet account or by any commercial or personal ChargeNet account for any business purpose, such as ridesharing, carsharing, delivery services or for any company owned vehicles.
(d) The Prize will be credited to the Winner’s personal ChargeNet account within 30 days of the end of the Competition Period.
(e) The Prize is not transferable and will not be exchanged or redeemed for cash.
(f) If the Prize item is unavailable, despite the Promoter’s reasonable endeavours to procure it, the Promoter reserves the right to substitute a different prize of equal or greater value.
(g) The Promoter makes no representation nor provides any warranties as to the quality or suitability of the Prize.
(h) Use of the Prize will be governed by these terms and conditions and the standard ChargeNet terms of use for ChargeNet charging stations and the ChargeNet App, at https://charge.net.nz/terms-conditions/.

5. Who May Enter

(a) The Competition is only open to persons who:
• are natural persons (i.e. not a company or other entity);
• have a personal ChargeNet account at the time of entry into the Competition and only to the extent they are using that ChargeNet account for personal use;
• are New Zealand citizens or permanent residents of New Zealand (being persons holding a current New Zealand Permanent Resident Visa); and
• are aged 18 years or over.
(b) The following persons are not eligible to enter the Competition:
• any entity who holds a commercial or business ChargeNet account;
• any person or entity using their personal ChargeNet account for business purposes (such as ridesharing, carsharing, delivery services or for any company owned vehicles);
• employees or independent contractors of the Promoter or any of its related entities;
• persons who are (or have been) otherwise directly involved with the Competition; and
• immediate family members of any of the above-mentioned persons.

6. How to enter

(a) To enter the Competition an entrant must, during the Competition Period:
(i) charge his or her vehicle (via his or her personal ChargeNet account) at any public ChargeNet charging station; and
(j) log in using the Promoter’s new ChargeNet App (App) at least once during the Competition Period. 
(b) An entry in the Competition will automatically be made by an eligible person each time he or she completes the actions described in clause (a)(i) and (ii) above. Although multiple entries may be made by eligible entrants during the Competition Period, no more than one entry will be accepted from any eligible person during any one day of Competition Period.
(k) Entries received outside the Competition Period will not be eligible for the Competition and will not be accepted by the Promoter.
(a) The Promoter takes no responsibility for entries that are late however caused (including but not limited to entries not received due to technical problems).
(l) Without creating an obligation to do so, the Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process, for submitting an entry which is not in accordance with these terms and conditions or for engaging in improper or unlawful conduct that may affect the fair and proper conduct of the Competition.
(m) The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their representatives, in any matters relating to the Competition.

7. Selecting the Winner 

(a) One entrant will be selected as the Competition Prize winner (Winner).
(b) The Winner will be randomly selected from eligible entries on 19 August 2024 (Draw Date).
(c) The Winner will be notified by email and phone call within 7 days of the Draw Date.
(d) If an entrant does not confirm by email or by phone receipt of this notification and acceptance of the Prize within 48 hours of receiving notification from the Promoter, the entrant forfeits the Prize and the Promoter may redraw a new Winner (and will notify the new Winner by email and phone call) within 48 hours of the redraw. Any redraw will be undertaken using the method specified in clause (b) above.
(e) A person purporting to be a Winner will be required to provide proof of identity and to verify any other eligibility requirements at the time of confirming acceptance of the Prize. If satisfactory proof and verification is not provided at this time (as determined by the Promoter), the entrant forfeits the Prize and the Promoter may re-draw a new Winner.
(f) The Promoter reserves the right to disqualify the Winner (and select another Winner).
(g) The Promoter’s decision is final and no correspondence will be entered into, including in the event of a dispute.

8. Promoting the Winner 

(a) By accepting the Prize, the Winner consents to his or her name and/or image being used for publicity purposes (including on the Promoter’s website and social media sites) as reasonably determined by the Promoter. The Winner agrees to make themselves reasonably available for this purpose, without compensation. In the event they are the Winner, each entrant consents to the Promoter and its licensees and representatives using the entrant’s name, likeness, image and/or photograph and voice, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of promoting the outcome of the Competition.
(b) Despite any promotion of the Winner on the Promoter’s social media sites, this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social network.

9. Privacy

(a) In accordance with the Privacy Act 2020, the Promoter notifies entrants that entry in this Competition involves the collection of personal information about entrants (which may include their name, address, mobile phone number, email address and photograph). This is collected for the purposes of establishing eligibility, carrying out the Competition, promoting the Competition and the Winner and, as necessary, identity verification and assessing compliance with these terms and conditions and the law. If the requested information is not provided, the entrant will not be eligible to participate in the Competition.
(b) The Promoter may disclose an entrant’s personal information to its personnel, representatives, other parties involved in administering the Competition, and any regulatory authorities (as required).
(c) By entering the Competition, each entrant consents to:
• the promoter’s privacy policy, which is available on the Promoter’s website at https://charge.net.nz/privacy-policy/;
• receiving ongoing communication from the Promoter (or its related entities), including its newsletter and other promotional material; and
• receiving commercial electronic messages (including SMS and email messages) from the Promoter (or its licensees) throughout the duration of the Competition and subsequently until such time as the entrant notifies the Promoter that he or she no longer wishes to receive such messages.
(d) It is the entrant’s responsibility to notify the Promoter if his or her contact details change during the period of the Competition. A request to access or modify any information should be directed to the Promoter at the address specified in clause 2 above.

10. Discontinuation of the Competition or Disqualification of an Entrant

(a) The Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute discretion may cancel, suspend, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants.
(b) The Promoter reserves the right, in its sole and absolute discretion, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with (or whom the Promoter reasonably suspects has tampered with) the entry process or the winner selection process or who has (or the Promoter reasonably suspects has) otherwise been misleading or fraudulent in the course of the Competition.

11. Exclusion of Liability 

(a) To the extent permitted by law, the Promoter is not liable (to any person, including any entrant or any or their representatives) for any loss or damage suffered or sustained by any person or to personal property (including, but not limited to, direct, indirect, consequential or economic loss) in connection with the Competition or the Prize.

12. Other Terms 

(a) If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions or otherwise running the Competition as planned, the Promoter will not be liable for any failure to perform or delay in performing its obligations.
(b) Failure by the Promoter to enforce any of their rights under these terms and conditions at any stage does not constitute a waiver of those rights.
(c) These terms and conditions are governed by the laws of New Zealand.
